审判情况研析

摘要：当前。北京市法院系统受理的医疗损害赔偿纠纷案件出现了数量逐年上升、各医院被诉案件数量比例较小、审理周期长、结案方式多元化等情况。各法院大多采取了成立专业审判组和诉讼管理办公室、积极探索多种调解模式和加强与处理医疗损害赔偿纠纷相关部门的沟通与协调的方式对这些情况进行解决。本文在审判经验的基础上，对医师、护士的执业资格、医疗机构就医疗费用提起反诉、住院医疗费用的审核、患方拒绝配合进行医疗事故鉴定和患者死亡的赔偿权利人等具体问题提出了审判对策。

近年来，随着我国医疗体制改革的不断深入以及患者对医疗需求程度的不断提高，医疗损害赔偿纠纷案件的数量不断上升，这给法院在审理医疗损害赔偿纠纷案件时带来了更多的难题。本文从北京市医疗损害赔偿纠纷案件的审判实践出发．对该类案件审判所涉及的一些问题进行探讨，以期引起关注和深人研讨。

一、北京市法院系统医疗损害赔偿案件审判的基本情况

(一)案件数量逐年上升

据北京市高级人民法院研究室统计，2006年，北京市法院系统共受理一审医疗损害赔偿纠纷案件428件，审结417件；其中，判决210件，撤诉121件，调解64件，裁驳18件，移送3件，终结1件。2007年。北京市法院系统共受理一审医疗损害赔偿纠纷案件468件，审结335件；其中，判决165件，撤诉72件，调解8l件，裁驳13件，移送3件，终结l 件。2008年，北京市法院系统共受理一审医疗损害赔偿纠纷案件715件，审结483件；其中，判决236件、撤诉118件、调解106件，裁驳14件，移送5件，
