今天,就下面签字的双方达成如下协议:

运费:每吨12美圆, 船东不负责装货、积载及平舱作业及费用

8.  PAYMENT TERMS: FULL FREIGHT TBP TO OWNER’S NOMINATED BANK ACCT WITHIN ONE MONTH AFTER COMPLETION OF LOADING
运费付款方式:全部运费在装货完毕后一个月内付到船东指定的银行账户上。
 
9.  CGO SHOULD BE AT SHPRS LOAD.COUNT AND MEASUREMENT OWRS ARE NO
T RESPONSIBLL FOR QTTY/QUALITY OF CGO LOADED/UNLOAD AND SHORTAGE AGAINST B/L QTTY OR DAMAGE CAUSED BY STEVEDORE EXCEPT SHIP'S DEFECT.
装船的货物数量及体积都是发货人提供的数据,船东对货物装船及卸港的数量和质量不负责,对货物提单数量的短少或因码头工人装卸时所造成的货物损害不负责,除非因为船东的过失。
10. FRT IS DEEMED AS EARNED UPON CARGO LOADED ON BOARD, DISCOUNTLESS  UNDEDUCTABLE/NON-RETURNABLE WHETHER VSL/CGO LOST OR NOT LOST
所有运费在装完货后即视为已赚取,不得扣减,无须返还,无论船舶/或货物灭失与否。
 
11.  BEFORE LOADING COMMENCES, OWNERS/MASTER SHOULD MAKE THE VSL’S HOLD TO BE CLEANED/DRIED N IN EVERY RESPECT READY TO LOAD A/M

灵敏度特异度装船前船东保证船舶装货前船舱干净、干燥,适合货物装运。
 
12.  OWNERS AGENTS BENDS/卸港代理,由船东自行指定和委托
 
13.  ANY TAXES/DUES/WHARFAGES ON CGO TBF THE CHRTS ACCT, THE SAME ON
    VSL/FRT TO BE FOR OWS ACCT
任何有关船舶的税费织里镇/码头费由船东负担,任何有关货物的由租船方负担。
 
14.  DETENTION: CHARTERERS PAY OWNERS USD5000 PER DAY OR PRO RATA IF
    CARGO AND/OR DOCUMENTS NOT READY UPON VSL’S ARRIVAL AT LDG/DISCG
    PORTS;
    如果该货或相关单证在船舶到达装港或卸港后未备妥,租船方须向船东每天支付5000美圆的滞留损失(不足一天按比例支付)。
 
15.  SHIPSIDE TALLY TO BE FOR OWS ACCT AND SHORESIDE TALLY CHTRS ACCT
    船边理货费用由船东承担,码头理货由租家承担
电气化铁路 
16  L/S/D TO BE FOR CHARTER’S ARRANGEMENT
绑扎/隔票/垫舱费用如有发生,由租船人承担。
 
17.  SHORE CRANE CHARGE TBF CHTR ACCT AT BOTH BENDS
租船人承担装货港及卸货港的租用岸吊费用。
 
18.  GA/ARBITRATION IF ANY IN SHANGHAI AND CHINESE LAW TO APPLY
仲裁地点在上海,中国法律适用
 
19.  OTHERS AS PER GENCON C/P ’94 DETAILS 其它条款按金康94标准合同格式执行
20.  COMBINE CGO ALLOWED    租家允许船东接收拼装货物

THE BALTIC AND INTERNATIONAL MARITIME COUNCIL UNIFORM GENERAL CHARTER
 (AS REVISED 1922, 1976 and 1994)
(To be used for trades for which no specially approved form is in force)
CODE NAME: "GENCON"
 
简介:统一杂货租船合同,“UNIFORM GENERAL CHARTER,简称“金康合同”(GENCON),由波罗的海国际航运公会的前身“波罗的海白海航运公会”于1922年公布,1976年及1994年两次修订。
 
1. It is agreed between the party mentioned in Box 3 as the Owners of the Vessel named in Box 5, of the GT/NT indicated in Box 6 and carrying about the number of metric tons of deadweight capacity all told on summer loadline stated in Box 7, now in position as stated in Box 8 and expected ready to load under this Charter Party about the date indicated in Box 9, and the party mentioned as the Charterers in Box 4 that:
兹由第3栏所列的下述船舶所有人与第4栏所指的承租人,双方协议如下:
吴栓牢
船舶名见第5栏,总/净登记吨见第6栏,货物载重量大约吨数见第7栏,现在动态见第8栏,根据本租船合同作好装货准备的大约时间见第9栏。
 
The said Vessel shall, as soon as her prior commitments have been completed, proceed to the loading port(s) or place(s) stated in Box 10 or so near thereto as she may safely get and lie always afloat, and there load a full and complete cargo (if shipment of deck cargo agreed same to be at the Charterers' risk and 10 responsibility) as stated in Box 12,
which the Charterers bind themselves to  ship, and being so loaded the Vessel shall proceed to the discharging port(s) or place(s) stated in Box 11 as ordered on signing Bills of Lading, or so near thereto as she may safely get and lie always afloat, and there deliver the cargo.
上述船舶一旦完成前个合同,应驶往第10栏所列的装货港口或地点,或船舶能安全抵达并始终浮泊的附近地点,装载第12栏所列的货物,满舱满载,(如协议装运甲板货,则由承租人承担风险。)(承租人应提供所有垫船用席子和/或木料及所需隔板。如经要求,船舶所有人准许使用船上任何垫舱木料。)承租人约束自己装运该货,船舶经此装载后,应驶往第11栏所列的,在签发提单时指定的卸货港口或地点,或船舶能安全抵达并始终浮泊的附近地点,交付货物
